These Terms of Use (the “Terms”) are an agreement between you and SparkScale Innovations LLC (“SparkScale”, “we”, “us” or “our”) for your use of the Wombly app for iPhone and Apple Watch (the “App”). By downloading or using the App, you agree to these Terms. If you don’t agree, please don’t use the App.
Our Wombly Privacy Policy explains how we handle your information, including your health data. It forms part of these Terms.
- Wombly is a tracking and wellbeing tool. It is not medical advice and not a method of birth control.
- Predictions and AI answers are estimates and can be wrong. Always talk to a healthcare professional about your health.
- Subscriptions are billed by Apple and renew automatically unless you cancel at least 24 hours before the period ends.
- The community has zero tolerance for abuse, harassment or objectionable content.
- You can delete your account and all your data inside the App at any time.
1. Who can use Wombly
You must be at least 13 years old to use the App. If you are under 18 (or the age of majority where you live), you need permission from a parent or guardian, and they must agree to these Terms and approve any purchase. In the EEA and UK, users under 16 (or the lower age set by local law) need parental permission. The partner program is only for people aged 18 or older. You may not use the App where the law does not allow it.
2. Not medical advice
The App shows general information and estimates, such as period, fertile-window, ovulation and due-date predictions, symptom insights, PCOS self-check results, pregnancy week information and AI-written answers. All of this is for information and self-tracking only.
- The App is not a medical device and does not give medical advice, a diagnosis or treatment.
- The App is not a method of contraception. Do not use it to prevent pregnancy, and do not rely on fertile-window or ovulation predictions to avoid or achieve pregnancy.
- The PCOS check is a self-reflection tool, not a test. Only a doctor can diagnose PCOS or any other condition.
- Predictions depend on what you log and on averages. They can be wrong, especially if your cycle is irregular, you are pregnant, postpartum, breastfeeding or using hormonal birth control.
- Never ignore or delay professional medical advice because of something you saw in the App.
In an emergency, such as heavy bleeding, severe pain, signs of labour or reduced baby movement, or if you are thinking about harming yourself, contact your doctor, midwife or local emergency number straight away.
3. Your account
When you first open the App, a private anonymous account is created automatically so your data can be backed up. You can optionally link it to Sign in with Apple, which is needed to restore your data on a new phone, to post or reply in the community, to invite a partner and to use AI answers.
You are responsible for keeping your device secure and for activity on your account. You can turn on App Lock (Face ID, Touch ID or passcode) in the App. You can delete your account and all your data at any time in Settings › Privacy & data › Privacy settings › Delete all my data, or, if you signed in with Apple, in Settings › Delete account. Deletion is permanent and cannot be undone, so export your data first if you want to keep a copy.
4. The Wombly service
The App helps you track your period, cycle, symptoms, moods, fertility, pregnancy and postpartum health. It offers predictions, charts, reminders, pregnancy tools, an Apple Watch app, optional Apple Health import, a community, a partner program and optional AI answers. We may add, change or remove features from time to time, and we don’t promise that any feature will always be available or work without interruption.
Reminders are scheduled on your iPhone and may not appear if notifications are turned off, your device is off, or iOS limits them. Don’t rely on the App alone for time-critical things such as taking medication.
5. AI answers
Some features use artificial intelligence (Claude, made by Anthropic) to write short, general answers. AI answers are optional. Nothing is sent until you agree on the “AI answers by Claude” screen, and you can turn AI answers off at any time in Settings › Privacy & data › Privacy settings. AI features need Sign in with Apple and have a daily limit.
AI answers can be inaccurate, incomplete or out of date. They are not medical advice, and they are not written or checked by a healthcare professional. Use them only as a starting point for a conversation with your doctor. You must not use AI features to create harmful, illegal or abusive content, or try to get around their safety limits.
6. Subscriptions and payments
Some features are part of Wombly Premium. Premium is offered as an auto-renewing monthly or yearly subscription, which may include a free trial. The price, length and what is included are shown in the App before you buy.
- Payment: payment is charged to your Apple ID account when you confirm the purchase. Apple processes all payments. We never see your card details.
- Auto-renewal: subscriptions renew automatically for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- Free trials: if a free trial is offered, it turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial ends when you buy a subscription.
- Managing and cancelling: manage or cancel your subscription in your iPhone’s Settings › [your name] › Subscriptions. Deleting the App or your Wombly account does not cancel your subscription.
- Refunds: refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
- Restoring purchases: you can restore an earlier purchase from the App on a device signed in with the same Apple ID.
- Price changes: if we change a subscription price, Apple will tell you in advance and, where required, ask for your consent before the new price applies.
- Free periods: AI answers and the PCOS check are free for your first 14 days in the App, and AI answers are free again for your first 14 days in pregnancy mode. After that they need Premium.
- Daily limits: some features, such as AI answers, have daily usage limits, even with Premium.
7. Community
Community lets members share experiences under a garden nickname and plant avatar instead of a photo or real name. Anyone can read the community. Posting, replying and voting need Sign in with Apple, and you must accept our community guidelines before you post.
We have zero tolerance for objectionable content or abusive users. You must not post anything that:
- harasses, bullies, threatens, shames or targets another person;
- is hateful or discriminatory, or attacks people based on race, ethnicity, religion, nationality, disability, gender, sexual orientation or similar characteristics;
- is sexually explicit or pornographic, or sexualises anyone under 18 in any way;
- is violent, encourages self-harm or eating disorders, or promotes dangerous or illegal activity;
- shares anyone’s personal information, including your own real name, contact details, photos of faces, or anything that could identify you or someone else;
- gives dangerous medical advice, sells or promotes medicines, supplements or treatments, or pretends to be a healthcare professional;
- is spam, advertising, scams, links to harmful sites, or content you don’t have the right to share.
You can report any post or reply and block any member from the ••• menu. Content you report is hidden from you straight away. A person reviews every report within 24 hours and may remove content and remove or ban members who break these rules. An automatic word filter may also refuse abusive text. Community posts are public and are the views of the members who wrote them, not of SparkScale.
8. Partner program
You can choose to share some of your information with a partner using a one-time pairing code. Inviting a partner needs Sign in with Apple and Premium; your partner’s app is free. If your Premium ends, sharing pauses until it is active again. You decide what is shared, and you can change it or unlink at any time. Only share a code with someone you trust. Once your partner has seen information you chose to share, it is outside our control. Partners must be 18 or older, must respect your privacy, and must not use the program to monitor, pressure or control anyone. Support messages must follow the same rules as the community.
9. Acceptable use
You agree not to:
- use the App for anything illegal, harmful or fraudulent;
- enter or share another person’s health information without their permission;
- get around paywalls, daily limits, safety filters, blocks or bans, or use more than one account to do so;
- use bots, scripts or automated tools to access the App or its servers;
- copy, modify, reverse-engineer or decompile the App, except where the law allows it;
- interfere with, overload or try to break the security of the App or our servers;
- resell, rent or share access to Premium; or
- pretend to be another person or organisation.
10. Your content
You own the information you log and the content you post. You give us a limited, worldwide, non-exclusive, royalty-free permission to store, back up, process and display your content only as needed to run the App for you (for example, to show your community posts to other members, or to send what you chose to share to your partner). This permission ends when you delete the content or your account, except for content a moderator is still reviewing. We don’t sell your content and don’t use it to train AI models. You are responsible for what you post and confirm you have the right to post it.
11. Third-party services
The App relies on third parties, including Apple (App Store, payments, Sign in with Apple, Apple Health and Apple Watch), Anthropic (AI answers), Supabase (database and backup), Cloudflare (community photo storage) and RevenueCat (subscriptions). Their services are governed by their own terms and privacy policies. We are not responsible for their availability or for content they provide.
12. Our app and licence
The App, including its design, code, text, graphics, name and logo, belongs to SparkScale and is protected by intellectual property laws. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own non-commercial use, in line with these Terms and Apple’s Usage Rules. “Apple”, “iPhone”, “Apple Watch”, “Apple Health” and “Claude” are trademarks of their owners. Wombly is not affiliated with or endorsed by them. If you send us feedback or ideas, we may use them without any obligation to you.
13. Suspension and termination
You can stop using the App and delete your account at any time. We may suspend or end your access to the community, the partner program, AI answers or the App if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the App. Where possible, we will tell you why. If we stop offering the App, we will give reasonable notice where we can so you can export your data. Sections 10 and 14 to 17 continue after these Terms end.
14. Disclaimer of warranties
To the fullest extent the law allows, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We don’t promise that predictions, AI answers or other information will be accurate or complete, or that the App will be error-free or uninterrupted. This does not affect consumer rights that cannot be excluded by law.
15. Limitation of liability
To the fullest extent the law allows, SparkScale is not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, or for any decision you make based on predictions or information in the App, including about contraception, conception or your health. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
16. Indemnity
To the extent the law allows, you agree to cover SparkScale’s claims, losses and reasonable legal costs that arise from your breach of these Terms, your content, or your misuse of the App.
17. Governing law and disputes
These Terms are governed by the laws of Pakistan, and the courts of Lahore have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring a claim in your local courts. Before starting any formal dispute, please contact us first so we can try to solve the problem.
18. Changes to these Terms
We may update these Terms when the App or the law changes. We will post the new version on this page and change the “Last updated” date. If a change is significant, we will tell you in the App before it takes effect. If you keep using the App after the change takes effect, you accept the new Terms. If you don’t agree, you can stop using the App and delete your account.
19. Apple App Store terms
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and SparkScale only, not Apple. SparkScale, not Apple, is solely responsible for the App and its content.
- Your licence is limited to using the App on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the fullest extent the law allows, Apple has no other warranty obligation for the App.
- SparkScale, not Apple, is responsible for handling any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims, including those relating to HealthKit.
- If a third party claims that the App infringes their intellectual property rights, SparkScale, not Apple, is responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must follow any applicable third-party terms, such as your mobile carrier’s terms, when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you.
Where these Terms don’t cover something, Apple’s Standard Licensed Application End User License Agreement applies.
