The short version
- HeyReps gives general fitness guidance. It is not medical advice. Check with a doctor before you start, especially if you are pregnant, injured or have a health condition.
- Subscriptions renew automatically until you cancel in your App Store or Google Play settings at least 24 hours before the period ends.
- Deleting the App or your account does not cancel a subscription.
- Trainers and gyms are responsible for what they publish. We do not tolerate objectionable content or abusive users, and you can report or block anyone.
1. Agreement
These Terms of Use (“Terms”) are an agreement between you and SparkScale Innovations LLC (“we”, “us”), Lahore, Pakistan, for the HeyReps app and related services (the “App”). By using the App you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.
If you downloaded the App from the Apple App Store, these Terms are the licensed application end user license agreement between you and us, and section 13 also applies.
2. Health and safety
The App is not a medical device and does not give medical advice. Workouts, plans, scores (such as recovery, strain, stress and biological age), research notes and anything published by trainers or gyms are general information. They do not diagnose, treat or prevent any condition.
- Consult a doctor or qualified health professional before starting any exercise programme, changing your diet, or fasting. This matters most if you are pregnant or postnatal, have a heart, blood pressure or other medical condition, are injured, or take medication.
- Stop exercising straight away and seek medical help if you feel pain, dizziness, faintness, shortness of breath or chest discomfort.
- Exercise involves risk of injury. You choose which exercises to do and with what weight, and you take responsibility for doing them safely, within your ability, with suitable equipment and space.
- Scores from Apple Health or Health Connect data are estimates and may be inaccurate.
- In an emergency, contact your local emergency services. Do not rely on the App.
3. Eligibility and accounts
- You must be at least 13 years old to use the App. If you are under 18, or under the age of digital consent where you live, you need a parent’s or guardian’s permission.
- You must be at least 18 to create a trainer or gym profile or to buy a subscription.
- Members can use the App without an account. Accounts use Sign in with Apple or Google. Keep access to that sign-in secure. You are responsible for activity on your account.
- You may delete your account at any time in Settings → Account → Delete account, or as described on our account deletion page.
4. Subscriptions and payments
The App is free to download. Some features need a paid subscription: Premium for members, Trainer Pro for trainers and Gym Pro for gym owners. Each is offered monthly or yearly, and Gym Pro includes Trainer Pro, which includes Premium. The price, period and any free trial are shown in the App before you buy, in your local currency.
- Payment: payment is charged to your Apple Account or Google Play account when you confirm the purchase. Apple or Google processes it, not us.
- Auto-renewal: your subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within the 24 hours before the period ends.
- Free trials: if a trial is offered and you do not cancel at least 24 hours before it ends, it converts to a paid subscription and you are charged. Any unused part of a trial ends when you buy a subscription.
- Managing and cancelling: on iPhone, go to Settings → your name → Subscriptions. On Android, go to Google Play → Profile → Payments & subscriptions → Subscriptions. You can also use Settings → Premium → Manage subscription in the App. Cancelling stops future renewals, and you keep access until the end of the period you paid for.
- Deleting the App or your HeyReps account does not cancel a subscription.
- Upgrades and downgrades between tiers are handled by Apple or Google under their rules, as shown when you change plans.
- Refunds are handled by Apple or Google under their refund policies. We cannot issue refunds for store purchases. This does not affect any rights you have under consumer law.
- Price changes: Apple or Google will tell you in advance and, where required, ask for your consent.
- Restore purchases: use Restore in the App to recover an active subscription on a new device signed in to the same store account.
- When a subscription ends, nothing you created is deleted. Paid features and higher limits stop until you subscribe again.
5. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial fitness use. Trainers and gyms may also use it to run their coaching or gym services. You may not copy, modify, resell, reverse engineer or extract the App, its exercise library, videos or images, except where the law allows it. Exercise videos, images, text and the HeyReps name belong to us or our licensors.
6. Community: trainers, gyms and their content
Trainers and gym owners can publish profiles and workout plans, and members can follow them. If you publish content:
- You keep ownership of it, and you give us a worldwide, non-exclusive, royalty-free licence to host, display and distribute it in the App, so the App can show it. The licence ends when you delete the content or your account, except for copies already shared with others, such as a plan assigned to a client.
- You confirm you have the right to publish it, including photos, and that the information about you, your qualifications and your gym is true.
- You are responsible for the advice you give and for your relationship with your clients or members. We are not a party to any arrangement, payment or service between trainers, gyms and members, which take place outside the App.
- You must accept and follow the community guidelines below when you create a profile.
The “Pro” tick on a profile shows that its owner holds a Trainer Pro or Gym Pro subscription. It is not an identity check, a qualification check or an endorsement by us.
7. Community guidelines and zero tolerance
We have zero tolerance for objectionable content and abusive users. You must not post or do anything that:
- Misrepresents you: impersonating someone, or claiming qualifications, awards or a gym you do not have.
- Is unsafe: dangerous training or diet advice, or medical claims (for example, that a plan cures or treats a condition).
- Disrespects people: harassment, hate speech, threats, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability or age.
- Is inappropriate: nudity, sexual content, violence, or content that is illegal or infringes someone’s rights.
- Breaks privacy: publishing other people’s personal information or photos without their permission.
- Is spam: misleading promotions, scams or repeated unwanted content.
Every profile and plan has Report and Block options. A blocked profile and its plans disappear from your view. We aim to review every report within 24 hours. We may remove content, hide profiles, and suspend or terminate the accounts of users who break these rules, without notice where safety requires it. If your content is removed and you think it was a mistake, email us to appeal.
8. Acceptable use
You must not misuse the App. That includes trying to access other users’ data or our systems without permission, interfering with the service, scraping it, using it to break the law, or getting around subscription features.
9. Third-party services
The App works with Apple, Google, Apple Health, Health Connect, and contact links that open WhatsApp, your phone, email or Instagram. Your use of those services is governed by their own terms, and we are not responsible for them.
10. Changes and availability
We may update the App, add or remove features, or change these Terms. If a change to the Terms is significant, we will tell you in the App before it applies, and continuing to use the App means you accept it. We try to keep the App available but do not promise it will be uninterrupted or error-free.
11. Disclaimers and limitation of liability
To the fullest extent the law allows, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for injury resulting from exercise you choose to do. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be limited by law. Nothing in these Terms affects the mandatory rights you have as a consumer where you live.
12. Termination
You can stop using the App and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections 2, 5 (ownership), 11 and 14 survive termination.
13. Apple App Store terms
If you got the App from the Apple App Store:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Your licence is limited to using the App on Apple-branded products you own or control, as the App Store’s Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for any claims about the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection claims, privacy claims, and intellectual property infringement claims.
- You confirm that you are not in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Where these Terms are silent, Apple’s Standard Licensed Application End User License Agreement applies.
14. Governing law and disputes
These Terms are governed by the laws of Pakistan, and the courts of Lahore have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring claims in your local courts. Before starting a formal dispute, please contact us so we can try to resolve it.
