FastChat Terms of Use

These Terms of Use (“Terms”) are an agreement between you and SparkScale Innovations LLC (“we”, “us”, “our”) for your use of the FastChat app for iPhone (“FastChat” or “the app”). They also serve as the End User License Agreement (EULA) for the app.

By downloading or using FastChat, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the app.

1. Who can use FastChat

• You must be at least 13 years old to use FastChat.
• If you are under the age of majority where you live, or under the minimum age your country sets for using online services on your own, you may use FastChat only with the permission of a parent or guardian. They must also agree to these Terms and approve any purchase.
• You may not use FastChat if the law forbids you from doing so.

2. Your account

• When you first open FastChat, we create a guest account for you. You can stay a guest or sign in with Apple. Guest accounts receive free starter credits, so guest mode is available once per device; after you sign out or delete your data, continuing requires Sign in with Apple.
• You are responsible for activity on your account and for keeping your device secure.
• You can delete your account at any time in Settings → Account. The Privacy Policy explains what is deleted.

3. The FastChat service

• FastChat gives you access to AI chat, image and photo tools, and other AI features. These are powered by third-party AI models that we reach through OpenRouter, from providers such as OpenAI, Google, Anthropic, xAI, DeepSeek, Moonshot AI, Mistral AI, Perplexity, Black Forest Labs and TypeSafe.
• AI features work only after you agree, in the app, to share your content with these providers. You can withdraw this consent in Settings → Legal → AI data sharing.
• We are constantly improving FastChat. We may add, change or remove features and AI models, for example when a provider retires a model. We will try to replace a retired model with a comparable one.
• FastChat needs an internet connection. We don’t guarantee that the service or any model will always be available or error-free.

4. Credits

Most AI features use credits. The app shows how many credits a model or feature costs before you use it.

• Subscription credits are added at the start of each paid subscription period. They are valid for that period only, and unused credits do not carry over when the subscription renews or ends.
• Free trial credits. During a free trial you receive a smaller trial allowance of credits. Your plan’s full credits are added when the first paid period starts.
• Bonus credits, such as welcome or referral credits, are free promotional credits. They expire after the period shown in the app and can be changed or withdrawn if they are obtained through abuse.
• Purchased credit packs, if we offer them, never expire.
• Credits have no cash value. They can’t be sold, transferred to another account, or exchanged for money, except where the law requires otherwise.
• If a request fails because of an error on our side, the credits for it are returned automatically.
• To prevent abuse and protect the service, daily usage limits may apply. When you reach one, the app tells you when it resets.
• We may change how many credits a feature costs in the future. The current cost is always shown in the app before you use the feature.

5. Subscriptions and payments

• Payment through Apple. All purchases are made through your Apple Account and processed by Apple. We never see your payment details.
• What you see before buying. The app shows each plan’s name, length, price and included credits before you confirm a purchase.
• Auto-renewal. Subscriptions renew automatically at the end of each period, at the same price and for the same length, unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
• Free trials. If a plan offers a free trial, you are charged the plan price when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial ends if you buy a subscription.
• Managing and cancelling. You can manage or cancel your subscription at any time in your iPhone’s Settings → [your name] → Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you paid for. Deleting the app or your FastChat account does not cancel a subscription.
• Refunds. Apple handles all refunds under its own policies. You can request one at reportaproblem.apple.com. If a purchase is refunded, the credits it gave you are removed.
• Price changes. If a subscription price changes, Apple will notify you in advance and, where required, ask for your consent before the new price applies.

6. Acceptable use

You agree not to use FastChat to create, upload, request or share anything that:

• is illegal, or helps someone break the law;
• sexualises, exploits or endangers minors in any way;
• is sexually explicit or pornographic;
• harasses, bullies, threatens or defames anyone, or promotes hatred or violence against people based on who they are;
• encourages or gives instructions for self-harm, suicide, or violence;
• depicts a real person in a sexual, humiliating or misleading way, or shows them without their consent (for example a “deepfake”);
• impersonates a real person or organisation, or is meant to deceive people into thinking AI-generated content is real;
• infringes someone else’s copyright, trademark, privacy or other rights;
• contains malware, spam or scams;
• gives instructions for weapons capable of mass harm, or for attacking computer systems.

You also agree not to:

• try to get around our safety filters, credit system, usage limits or paywall;
• access FastChat with bots, scripts or other automated means, or resell access to it;
• copy, decompile or reverse-engineer the app, except where the law allows;
• interfere with or overload our servers;
• break the usage policies of the AI providers whose models you use.

Our automated filters may refuse requests that appear to break these rules.

7. Photos of people

• Upload only photos that you have the right to use.
• Before using a photo of anyone other than yourself in tools such as Face Swap, Hairstyle or Try Outfit, you must have that person’s consent. For a minor, you need the consent of their parent or guardian.
• Face Swap works only with photos you upload. Requests to use celebrities or other named people are not allowed.
• Never use edited images to embarrass, deceive or harm the people in them.

8. Your content and AI output

• Your content. You keep ownership of the text, photos, files, links and recordings you submit (“your content”). You give us a limited permission to process your content, and to send it to our service providers and AI providers, only to provide FastChat to you, as the Privacy Policy describes.
• AI output. As between you and us, you own the AI responses and images created for you, and you may use them for personal or commercial purposes, as long as your use follows these Terms and the law.
• Output may not be unique. Other users may receive similar output. In some countries AI-generated material may not be protected by copyright.
• Your responsibility. You are responsible for your content and for how you use AI output. Please make clear that content is AI-generated where people could be misled.
• No training. We do not use your content to train AI models.

9. AI limitations: important disclaimers

• AI can be wrong. Responses may be inaccurate, incomplete, out of date or offensive. Always check important information yourself.
• FastChat does not give professional advice. AI output is not medical, legal, financial, tax, investment or psychological advice.
• Crypto Insights shows public market data and AI commentary only. It is not financial advice and never a recommendation to buy or sell.
• Ask Religion gives general information. It is not a religious ruling; consult a qualified scholar for guidance.
• Decision Maker and AI Battle are aids for thinking, not decisions you must follow. You are responsible for your choices.
• AI characters and assistants are not real people.
• In an emergency, or if you are thinking about harming yourself, contact your local emergency services or a crisis line right away. Don’t rely on FastChat.

10. Reporting content

Every AI result has a Report button. Use it to report output that is harmful, offensive or breaks these Terms. You can also email us. We review reports and may use them to improve our safety filters.

11. Third-party services

FastChat relies on third-party services, including OpenRouter and AI model providers, Apple, RevenueCat and Supabase. Some features use public data from other sources, such as web pages and YouTube videos you share, or Binance’s public market data. We are not responsible for third-party content, for the accuracy of public data, or for the availability of these services.

12. Our app and licence

• FastChat, including its design, code, name and logo, belongs to us or our licensors and is protected by law.
• We grant you a personal, non-exclusive, non-transferable, revocable licence to use FastChat on Apple devices you own or control, as allowed by these Terms and Apple’s Usage Rules.
• GPT, Claude, Gemini, Grok, DeepSeek, Kimi, Mistral, Perplexity, FLUX, YouTube and other names are trademarks of their owners. FastChat is an independent app, and these owners are not affiliated with it and do not endorse it.
• If you send us feedback or ideas, we may use them without any obligation to you.

13. Suspension and termination

• You can stop using FastChat at any time and delete your account in the app.
• We may suspend or close your account, or remove credits obtained through abuse, if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the service. Where appropriate, we will tell you why.
• If we discontinue FastChat, we will give reasonable notice where we can.

14. Disclaimer of warranties

To the maximum extent the law allows, FastChat is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

15. Limitation of liability

To the maximum extent the law allows:

• we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of FastChat or of AI output;
• our total liability for any claim relating to FastChat is limited to the amount you paid for FastChat in the 12 months before the claim, or USD 50, whichever is greater.

These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

16. Indemnity

To the extent the law allows, you agree to compensate us for claims, losses and costs (including reasonable legal fees) that arise because you broke these Terms or misused FastChat or AI output.

17. Governing law and disputes

These Terms are governed by the laws of Pakistan, and the courts of Lahore have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.

18. Changes to these Terms

We may update these Terms, for example when we change features or when the law changes. We will update the effective date above and, for significant changes, give notice in the app or on this page before they take effect. If you keep using FastChat after the changes take effect, the new Terms apply. If you don’t agree, you can stop using the app and delete your account.

19. Apple App Store terms

Because you downloaded FastChat from Apple’s App Store, these terms also apply:

• Agreement. These Terms are between you and SparkScale Innovations LLC only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for FastChat and its content.
• Licence. Your licence to use FastChat is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions. FastChat may also be used by other accounts linked to you through Family Sharing or volume purchasing, if available.
• Maintenance and support. We are solely responsible for maintenance and support of FastChat. Apple has no obligation to provide any maintenance or support services for it.
• Warranty. If FastChat fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent the law allows, Apple has no other warranty obligation for FastChat. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent they are not disclaimed in these Terms.
• Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to FastChat or your use of it, including product liability claims, claims that FastChat fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• Intellectual property. If a third party claims that FastChat or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• Legal compliance. You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms, such as your mobile carrier’s or internet provider’s, when using FastChat.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
